Regarding Drug Charges in Canada

The Controlled Drugs and Substances Act (formerly the Narcotics Control Act) defines drug offences, with prohibited or controlled substances listed in schedules attached to the Act. The prosecution of drug offences is the responsibility of the federal government. The Public Prosecution Service of Canada employs prosecutors.

The following are the drug offences:

1. Possession of a Prohibited or Controlled Substance
2. Possession of a Controlled Substance for the Purpose of Trafficking
3. Trafficking in a Prohibited or Controlled Substance
4. Producing, Cultivating or Growing a Controlled Substance
5. Importing, Exporting or Possessing for the Purpose of Exporting a Controlled Substance

As with all criminal offences, the investigation, arrest, and prosecution must adhere to the rights outlined in the Canadian Charter of Rights and Freedoms. The right to be presumed innocent and not found guilty unless the allegation is proven beyond a reasonable doubt is included.

If the judge is satisfied that the evidence obtained by the police (usually the drug) was obtained in a manner that violated the defendant’s rights, the judge may dismiss the charges upon application by the criminal lawyer.
